Terms of service

What you are agreeing to when you buy a service from us, in the plainest language we can manage.

1. Who these terms are between

These terms are between you and OMLINUX, operated by PwTech of Rajkot, Gujarat, India. By ordering or using a service you accept them. If you are agreeing on behalf of a company, you confirm you are entitled to bind it.

2. What we provide

Shared hosting, Windows hosting, cloud VPS and dedicated servers, as specified on the plan you order. The specification and price of every plan we sell is published on our pricing page, and the plan page is the definition of what you are buying.

Availability, service credits and hardware response are governed by our service level agreement, which forms part of these terms.

3. Your account

Give us accurate details and keep them current — we bill and contact you using them. You are responsible for your credentials and for everything done through your account, so tell us immediately if you believe it has been compromised. We verify the details on new accounts before full ordering and billing access is enabled.

4. Prices, GST and payment

Prices are in Indian rupees and exclude GST. Services are billed in advance, monthly or annually as you choose, with a minimum term of one month.

Indian GST is added at the applicable rate where the supply is made in India. A sale to a customer outside India is invoiced as a zero-rated export, with no Indian GST added; where we hold a tax registration in your own country, that country's tax is charged instead. Every invoice states which of these applies to it. If you are invoiced in another currency, the figure shown is a conversion for your convenience and the amount payable is the rupee amount on the invoice.

We do not increase your price at renewal: a service renews at the price you ordered it at for as long as we continue to offer that plan. If we ever need to change the price of a plan you already hold, we will tell you at least 30 days beforehand and the change can only take effect from your next renewal — never mid-term. If a plan is withdrawn we will offer you the nearest equivalent and the same notice.

5. Late payment and suspension

Invoices are due by the date shown on them. We send reminders before and after the due date. If an invoice remains unpaid we may suspend the service, and a service that stays suspended may eventually be terminated and its data deleted — we will have told you before that point, at the address on your account. Keep your billing address current for exactly this reason.

6. Cancelling

Cancel at any time from your client area. Cancellation takes effect at the end of the period you have already paid for, and we do not refund part of a period unless we have agreed otherwise in writing. We do not publish a money-back guarantee; the one-month minimum term is what keeps your commitment small.

7. Acceptable use

Do not use our services for anything unlawful, or in a way that damages or degrades our infrastructure or another customer's service. Specifically prohibited:

  • Distributing malware, or running phishing or fraud infrastructure
  • Unauthorised access to, or scanning of, systems and networks
  • Sending unsolicited bulk email, or hosting anything advertised by it
  • Hosting content that infringes someone else's intellectual property
  • Cryptocurrency mining, without written agreement from us first
  • Sustained load that degrades a shared server for the customers you share it with

We act on credible abuse reports. Where we can, we will contact you first and give you a chance to fix it; where the activity is causing active harm, we may suspend immediately and tell you afterwards.

8. Your data and your backups

Your content remains yours. We access it only to operate the service, to fix a fault, or where the law requires it.

Backups are your responsibility. We have not published a backup policy, so do not assume a restorable copy of your data exists on our side — ask us what is in place for your plan before you rely on it. We are not liable for data loss.

9. Limitation of liability

Our total liability for any claim is limited to what you paid us for the affected service in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profit, lost business or lost data. Service credits under the SLA are your remedy for unavailability. Nothing here excludes liability that cannot lawfully be excluded.

10. Changes to these terms

We may revise these terms. Material changes are posted here with the date above updated, and we will tell you about them by email before they take effect for services you already hold.

11. Governing law

These terms are governed by the laws of India, and the courts at Rajkot, Gujarat have exclusive jurisdiction over any dispute arising from them.
